Welcome to chatpatevastra.com (the "Store"), operated by Chatpate Vastra ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of the Store and any purchase you make. By accessing or buying from the Store, you agree to these Terms. Please read them carefully. If you do not agree, please do not use the Store.

These Terms should be read together with our Privacy Policy, Shipping Policy, and Returns and Refunds Policy, which form part of these Terms.

1. Eligibility

By using the Store, you confirm that you are at least 18 years old and able to enter into a legally binding contract under the Indian Contract Act, 1872. If you are under 18, you may use the Store only with the involvement of a parent or guardian.

2. The Store and our products

We sell women's fashion, including dresses and tops. We are the seller of record for orders placed on the Store and are responsible for your order to you, subject to these Terms and applicable law.

We try to display our products, colours, prints, and details as accurately as possible. However:

actual colours may vary slightly depending on your screen settings;
because many items are shown on models or in styled or lifestyle imagery, the item you receive may vary slightly in styling, fit, or presentation from the images;
products are subject to availability, and we may update or remove listings at any time.

3. Pricing and payment

All prices are listed in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
We reserve the right to change prices, offers, and discounts at any time, and to correct pricing errors.
If a genuine pricing or listing error affects your order, we will contact you to confirm the order at the correct price or cancel it. If we cancel a paid order for this reason, you will be refunded in full.
Payments are processed by third-party payment gateways authorised under Indian law. We are not responsible for issues arising from the payment gateway or your bank, such as declined transactions or processing delays. Your payment is also subject to the gateway's own terms.

4. Orders

Once you place an order and payment is successful, you will receive a confirmation.
We reserve the right to accept, refuse, or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, stock unavailability, or incomplete or incorrect information.
If we cancel a paid order, you will be refunded for that order.

5. Shipping and delivery

We ship across India. Estimated delivery timelines are shown at checkout or on our Shipping Policy page.
Some orders are fulfilled through our sourcing and logistics partners, so delivery timelines may vary by product and location.
We are not responsible for delays caused by couriers, weather, regional disruptions, incorrect addresses provided by you, or other events outside our reasonable control, though we will help resolve issues where we can.
Please ensure your shipping address and contact details are accurate. We are not responsible for orders that fail to deliver due to incorrect details provided by you.

6. Returns, replacements, and refunds

Our returns are handled as set out in our Returns and Refunds Policy, summarised here:

We accept return or replacement requests only where the item delivered is damaged, defective, wrong, not as described, or missing from your order.
We do not accept returns for change of mind, incorrect size selection, or minor variations in colour or styling as described in Clause 2.
You must raise any such claim within 48 hours of delivery and provide a clear unboxing video and photos as proof. We strongly recommend recording an unboxing video when you open your parcel, as it is required to process most claims.
Once your claim is verified and approved, we will arrange a replacement or refund as set out in the Returns and Refunds Policy.
Refunds, where approved, are made to your original payment method within the timelines stated in that policy.

In case of any conflict between these Terms and the Returns and Refunds Policy, the Returns and Refunds Policy applies to returns and refunds.

7. Acceptable use

When using the Store, you agree not to:

use the Store for any unlawful or fraudulent purpose;
interfere with, disrupt, or attempt to gain unauthorised access to the Store, its systems, or other users' data;
copy, reproduce, or misuse our content, brand name, logo, images, or product listings without permission;
post or transmit anything unlawful, defamatory, obscene, or infringing on others' rights.

We may suspend or restrict your access to the Store if we reasonably believe you have breached these Terms.

8. Intellectual property

The Store's content, including our brand name "Chatpate Vastra", logo, original text, and original imagery, belongs to us and may not be copied, reproduced, or used without our written permission. Product images sourced from suppliers remain the property of their respective owners.

9. Reviews and content you submit

If you submit reviews, photos, or other content to the Store, you grant us a non-exclusive, royalty-free right to use, display, and share that content for operating and promoting the Store. You are responsible for what you submit and confirm you have the right to share it. We may remove any content at our discretion.

10. Limitation of liability

To the extent permitted by law:

the Store and our products are provided on an "as is" and "as available" basis;
we are not liable for any indirect, incidental, or consequential loss arising from your use of the Store or our products;
our total liability for any order is limited to the amount you paid for that order.

Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be excluded.

11. Force majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural events, strikes, courier disruptions, technical failures, or changes in law.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Store are subject to the exclusive jurisdiction of the courts of [CITY], Maharashtra.

13. Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated "Last updated" date. Continuing to use the Store after changes means you accept the updated Terms.
